Online gambling was previously prohibited in the Netherlands. However, the passage and eventual enactment of the long-awaited Remote Gambling Act (KOA) finally allowed the market to open.


The KOA officially came into effect on April 1, 2021, enabling the regulated iGaming market to launch six months later, on October 1 of the same year.


The Regulation further clarifies the provisions outlined in the Decree and governs the following areas:


  • Remote gambling licensing and operations.

  • The organization of remote gambling, including the licensee’s integrity policy, access to remote gambling, management of gambling credits, consumer protection, the gambling system, and inspection procedures.

  • Compliance supervision and enforcement, including recording and reporting obligations, and the use of a control data base (data safe) for monitoring purposes.


The amended Betting and Gambling Act (BGA) does not introduce a licensing system for B2B service providers. Suppliers such as software vendors and affiliates are, in principle, free to offer their services to locally licensed remote gambling operators. That said, B2C operators are subject to extensive outsourcing requirements, which means we must obtain certification to provide our sportsbook in the Netherlands.


Furthermore, license holders remain responsible for advertising activities carried out by affiliates.

Every two months, the regulator consults with the DNB, AFM, BFT, BTWwft, NOvA, FIU, JenV, and MinFin regarding Wwft compliance supervision.
